Uttar Pradesh: A petition was filed by the Railways in the Supreme Court to stop the demolition near the Krishna Janmabhoomi in Mathura, which the court agreed to hear yesterday. A bench headed by Chief Justice of India DY Chandrachud assured the petitioner that they will hear the matter on August 16.

Senior advocate Prashanto Chandra Sen mentioned the plea before the bench. He said that the courts were closed due to the bullet death of a lawyer in Uttar Pradesh, so the matter should be heard immediately. He also said that the authorities have started the demolition from August 9. People have been living in this place since 1800.

What did the petitioner say in court?

He has demanded the Mathura Railway authorities to stop the demolition process. The petitioner filed a civil suit in the Civil Court Senior Division, Mathura seeking permanent injunction against the Railway Authority but in the meantime the demolition work started on August 9, 2023. The petitioner further stated that he was challenged on the very next day i.e. 10th August.

The Railways has started the process of demolishing the houses of the petitioners.

Please be informed that on August 10, the Railways counsel said that they have no instructions for demolition and will bring instructions to the Civil Court. On this, the petitioner added that due to the incident of shooting of a lawyer, all judicial proceedings in Allahabad have been suspended as per a resolution passed by the Bar Council. Taking advantage of the situation, the railway authority has arbitrarily started the process of demolishing the houses of the petitioners.

In this petition filed in the court, the whole process has been termed as illegal, arbitrary and in violation of Article 21 of the Constitution of India.
