Service extended three times

The Supreme Court overturned the Union government’s decision to extend the tenure of current ED Director Sanjay Mishra and refused to grant any extension of service beyond September 15. Sanjay Kumar Mishra was appointed as the ED Director in 2018, with his initial term scheduled to end in November 2020. However, the central government extended his service three times. The CVC Act was amended to extend their tenure. On July 27, the Supreme Court agreed to extend Mishra’s term till September 15. Earlier, he was scheduled to retire from office on July 31.

The Supreme Court ordered no extension after September 15.

A special bench of Justices BR Gavai, Vikram Nath and Sanjay Karol had ordered that in normal circumstances we would not entertain such a plea… Keeping in mind the larger public interest, we have decided to extend the tenure of the ED Director. Extending until September. 15, 2023. Allow stay. The bench, however, made it clear that it would not consider the Centre’s plea to extend his tenure. It said that Mishra will cease to hold office from midnight of 15/16 September 2023.

At the beginning of the hearing, the bench asked whether the ED had no other competent authority to deal with the FATF review. Aren’t you getting the picture that your entire department is full of incompetent officers? You only have one officer? The bench asked whether this is not demoralizing the entire force.
