Akola West Assembly seat in Maharashtra was supposed to hold a by-election on April 26 but now the by-election has been banned. In fact, the Election Commission has decided to ban by-elections on this seat as the new member who wins this seat will get less than a year. The Bombay High Court has said that there cannot be a by-election on this seat.

Let us tell you that the gazette notification regarding the process of nomination papers for the election of this assembly seat was issued on Thursday itself and the by-election was to be held here on April 26 and the election results were to be declared on June 4. . Now the Election Commission says that the notification of the by-election on the Akola West seat is being canceled following the directions of the Nagpur Bench of the High Court.

The High Court imposed a ban.

A bench of Justice Anil Kalur and Justice MS Jwalkar had on Tuesday said that there would be no by-election to the Akola West assembly seat. The court had said that this was a violation of Section 151 (A) of the Representation of the People Act. Let you know that the Akola West Assembly seat fell vacant due to the death of outgoing MLA Govardhan Sharma. He was a BJP leader and died on 3 November 2023. The court said that there will be no by-elections on the seat vacated by his death as whoever wins the seat will get less than a year.

An application was made to the court.

The court gave this direction while hearing a petition, in which the petitioner had said that since assembly elections are going to be held in Maharashtra soon, holding by-elections is a waste of money. Along with this, the petitioner had also said that after the declaration of results on June 4, MLAs will get only four months to work.
